AIHIRE.IO TERMS OF USE

1. Acceptance and Ownership of Terms
These Terms of Use ("Terms") are a binding agreement between you and XEONTRIX LLC, a limited liability company and the owner/operator of AIHire.io (referred to herein as "AIHire.io," "we," "us," or "our").
XEONTRIX LLC is the legal entity behind the Service, located at 525 Randall Ave Ste 100, #862, Cheyenne, WY 82001.
By accessing or using the AIHire.io platform and Services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, you may not access or use the Service.
2. Definitions
- Client (Recruiter): A business, organization, or individual using the Service to post job openings, conduct AI assessments/interviews, and evaluate Talent.
- Talent (Candidate): An individual using the Service to apply for jobs and participate in AI assessments/interviews.
- User: Collectively, Clients and Talent.
- User Content: Any data, video responses, files, or information you submit, post, or display on or through the Service.
- AI Results: The scores, analysis, insights, recommendations, and other data generated by the Platform's artificial intelligence and machine learning models based on User Content.
3. Service Description
AIHire.io provides AI-powered tools to streamline recruitment, including job post generation, skill assessments, AI interviews, and candidate pipeline management.
4. User Accounts and Security
- Eligibility: You must be at least 18 years old to use the Service.
- Accuracy & Security: You agree to provide accurate, current, and complete information and are solely responsible for safeguarding your account password. AIHire.io is not liable for any loss or damage resulting from your failure to protect your account credentials.
5. Client (Recruiter) Obligations
- Legal Compliance: Clients are solely responsible for compliance with all local, state, national, and international laws, including all employment, non-discrimination, and data privacy laws (e.g., GDPR, CCPA).
- Data Controller: Client is the data controller for all Talent data collected via the Service. The Client agrees to use AI Results and personal data solely for internal hiring purposes and will not misuse, sell, or disclose such data.
- Final Decision: Client acknowledges that all hiring decisions are the sole responsibility of the Client, and not AIHire.io or the AI Results provided by the Platform.
6. Talent (Candidate) Obligations and Prohibited Conduct
- Accuracy and Integrity: Talent must provide truthful information. You are strictly prohibited from using external assistance, deceptive means, or unauthorized generative AI models to complete assessments or interviews.
- Consequences: Any violation of assessment integrity or professional conduct may result in the immediate and permanent termination of your account and reporting of the violation to the hiring Client.
7. Intellectual Property
- AIHire.io IP: The Service, its original content, features, functionality, and proprietary software, are and will remain the exclusive property of AIHire.io and XEONTRIX LLC.
- User Content IP: You retain all ownership rights in your User Content. You grant AIHire.io an irrevocable, worldwide, non-exclusive, royalty-free license to use aggregated, anonymized, and de-identified data derived from your User Content and AI Results for the sole purposes of platform improvement, internal research, quality control, and the training of our AI/machine learning models.
8. AI Disclaimer and User Responsibility
- AI is a Tool: The AI Results are provided as an automated tool to assist in the recruitment process. They are not a guarantee, prediction, or warranty of job performance, legal compliance, or suitability.
- No AI Responsibility: AIHire.io and XEONTRIX LLC take NO responsibility for the accuracy, completeness, or reliability of any AI Results or any data derived from the AI models.
- User Verification Required: The User (Client or Talent) is solely responsible for independently reviewing, verifying, and confirming all AI Results and must apply human judgment and common sense before making any decision based on the AI output.
- No Liability for Decisions: AIHire.io is not liable for any employment decisions, financial losses, or adverse outcomes resulting from a Client’s reliance on the AI Results.
9. Disclaimers, Accessibility, and Limitation of Financial Liability
- Service "AS-IS": The Service is provided on an "AS IS" and "AS AVAILABLE" basis, with all faults and without warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
- Accessibility: AIHire.io strives to follow Web Content Accessibility Guidelines (WCAG) to the extent commercially reasonable. However, we do not warrant that the Service is fully compliant with all accessibility standards across all user devices, browsers, and assistive technologies. Users are responsible for procuring and using the necessary compatible software and devices to access the Service.
- LIMITATION OF FINANCIAL LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AIHIRE.IO, XEONTRIX LLC, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.
- LIABILITY CAP: In no event shall the total cumulative liability of AIHire.io or XEONTRIX LLC for any and all claims related to the Service exceed the greater of (a) One Hundred U.S. Dollars ($100.00) or (b) the amount paid by the Client to AIHire.io for the past six (6) months of service.
10. Indemnification
You agree to defend, indemnify, and hold harmless AIHire.io and XEONTRIX LLC from and against any and all claims, damages, obligations, losses, costs, liabilities, or debt (including attorney's fees) arising out of:
- Your use of the Service;
- Your breach of any term of these Terms; or
- For Clients: Your hiring decisions, employment practices, or alleged violation of any privacy or labor laws.
11. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of [Insert Governing Jurisdiction, e.g., The State of Wyoming], without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved in the competent courts of [Insert Governing Jurisdiction's City/County].
12. Changes to the Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.1
